Pipe Technologies Inc. Global Privacy Policy

    1. Scope

    The Pipe Technologies Inc. Global Privacy Policy (“Policy”) applies to the collection of Personal Data processed by Pipe Technologies Inc. and all of its subsidiaries such as Pipe Technologies UK Limited (“us”; “our”; “Pipe”), including on our websites, our services, and other online or offline offerings. To make this Policy easier to read, our websites, services, and other offerings are collectively called "Services." For the purpose of this Policy, Personal Data is generally defined as “any data which is related to an identified or identifiable natural person or household.”

    In addition to reading this Policy, please review our Terms of Service (“Terms”) which governs your use of our websites (“Sites”). If you do not agree to our Terms and the collection, use, and sharing of your Personal Data as detailed in this Policy, please do not access or otherwise use the Sites.

    2. Personal Data We Collect


    2.1 – Categories, Types, Sources and Purposes for the Personal Data We Collect

    The categories of Personal Data we collect depend on how you interact with us, our Services, and applicable legal requirements. We collect Personal Data that you provide to us, Personal Data we obtain automatically when you use our Services, and Personal Data from other sources such as Third-Party Services, defined in this Policy as websites, applications, platforms, products, or services that may reference, link to, or interface with our Services that are not controlled by us, and other organizations, as described below.

    • Contact Information. Names, email addresses, postal addresses (including zip codes), telephone numbers, company registration numbers, other professional details, and other profile information you choose to provide, including information you provide by “linking” other data sources, integrations, or similar services to Pipe. This includes Personal Data provided to us when you participate in our research studies and surveys or register for conferences and events that Pipe hosts.

    • Your Communications with Us. We may collect Personal Data, such as email addresses, phone numbers, or mailing addresses when you request information about our Services, register for our product, attend or request customer or technical support, or otherwise communicate with us. We may also collect such information including phone numbers, calling-party numbers, forwarding numbers, time and date of calls, duration of calls, SMS routing information.

    • Interactive Features. We and others who use our Services may collect Personal Data that you submit or make available through our interactive features (e.g., profile pages which are available to other Pipe users, messaging and chat features, commenting functionalities, forums, blogs, and social media pages). Any information you provide using the public sharing features of the Services will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein.

    • Sweepstakes or Contests. We may collect Personal Data you provide for any sweepstakes or contests that we offer. In some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.

Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity; c. Authenticating and verifying individual identities, including requests to exercise your rights under this Policy and for reviewing credit standing and d. complying with our obligations.

    3) Marketing and advertising our Services, including through email campaigns, custom audiences advertising, and “interest-based” or “personalized advertising,” (e.g. cross-device tracking); and

    4) For other purposes as requested by you and/or as permitted by applicable law.

    Category of Personal Data - Financial Information

    Types of Personal Data Collected

    • Payment Data. We may collect payment data including bank account information and credit card information. We may also collect data to verify your identity and conduct Know-Your-Customer (“KYC”) checks. This may include receiving a written authorization from yourself and other company personnel to obtain consumer credit reports, details about the business, acquirer Merchant ID(s), information about the purpose for which the company is requesting funding, the company’s current and historical card takings, chargeback and refund data, as well as its Merchant Category Code(s) and/or industry type, other reports such as credit, fraud and Office of Foreign Asset Control (“OFAC”) reports on each member of the company, and confirmation that the company is continuing to take payments through the card terminal(s) provided to us. We may also ask you to verify the percentage of ownership in your company.

    • Underwriting Data. We may collect the following Personal Data to help us with underwriting services for processing. This can include information such as the currency used, payout amounts, transaction counts, chargeback amounts, and days of transaction activities.

    Category of Personal Data - Audio, electronic, visual, thermal, olfactory or similar information

    • Video Recordings. We may collect any video or voice recordings taken during our research studies.

    Category of Personal Data - Online Information

    Types of Personal Data Collected

    • Device Information. We may collect information related to your use of the Sites such as your device model, operating system, unique device identifiers, mobile network information, server logs, IP addresses or MAC addresses.

    • Digital or Technical Information. We may collect such information related to your visits to our Sites or use of our mobile apps, pages visited, system activity, hardware settings, browser type, browser language, the dates and times of your requests and referral URL, broad geographical information, navigation patterns.

    • Certain Specialized Information. If you use certain mobile apps or Sites, we may collect and store information locally on your device such as browser web storage (including HTML 5) and application data caches. Certain services may include a unique application number in connection with the installation of our mobile apps. This number and information, including, without limitation, operating system type and app version number may be sent to our Service Providers (as defined in Section 3.1) when you install, update or uninstall our mobile app.

    Types of Personal Data Collected

    • Business Information. We may collect information related to your business such as your employment contacts, job titles, and work emails.

    • Business Development and Strategic Partnerships. We may collect Personal Data from individuals and third parties to assess and pursue potential business opportunities.

    • Job Applications. We may post job openings and opportunities on our Services. You may reply to one of these postings by submitting your application, CV, cover letter, and/or other information to us.

    1) Fulfill our contract with you and provide you with our Services, including but not limited to: a. Managing your information and accounts; b. Deciding whether to offer you a Pipe product or service; c. Monitoring your account and linked data for eligibility for future Pipe products or services; d. Enabling you to access our Services through Third-Party Services, such as our referral or embedded partners; and e. Carrying out activities that we determine are necessary or appropriate as it relates to our Services.

    2) For various administrative purposes including but not limited to: a. Pursuing our legitimate interests such as direct marketing, research and development (including marketing research), network and information security, and fraud prevention; b. Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity; c. Authenticating and verifying individual identities, including requests to exercise your rights under this Policy and for reviewing credit standing and d. complying with our obligations.

    3) Marketing and advertising our Services, including through email campaigns, custom audiences advertising, and “interest-based” or “personalized advertising,” (e.g. cross-device tracking); and

    4) For other purposes as requested by you and/or as permitted by applicable law.

    In addition to the purposes for collecting and using your Personal Data listed in the tables above, we may also collect and use your data for the following purposes:  

    • Consent. We may use Personal Data for other purposes that are clearly disclosed to you at the time you provide Personal Data or with your Consent. Consent is defined as “freely given, specific, informed and unambiguous indication of your wishes by which you, by a statement or by a clear affirmative action, signifies agreement to the processing of Personal Data relating to you.”

    • De-identified and Aggregated Information. We may use Personal Data and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Services, or other analyses we create.

    • Share Content with Friends or Colleagues. Our Services may offer various tools and functionalities. For example, we may allow you to provide information about your friends through our referral services. Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services. Please only share with us contact information of people with whom you have a relationship (e.g., relative, friend, neighbor, or co-worker).

    2.2 – Our Use of Cookies and Other Online Tracking Technologies

    We and our service providers use various tracking technologies (e.g., cookies, pixels, web beacons, etc.) to collect information automatically. The information collected may include details about your behavior on our Sites, including how you move and scroll through the Sites, your keystrokes, the links you choose to click, and how you interact with forms. These technologies may also be used to collect information about you over time and across different websites, mobile apps, and devices.

    • Cookies. Cookies are small text files placed in device browsers that store preferences and facilitate and enhance your experience.

    • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in our Services that collects information about engagement on our Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

    • Session Replay. These cookies record your interactions with our websites, including mouse movements, text, and other information, associated with your visit to our Sites and/or Services. This information is used to help us improve our websites and better provide you with information you are interested in when you visit our websites. They may be set by us or by third party providers whose services we have added to our pages. 

    • Social Media. We may use certain social media cookies that are set by a range of social media services that we have added to the Sites to enable you to share our content with your friends and networks on those platforms. They are capable of tracking your browser across other websites and building up a profile of your interests. This may impact the content and messages you see on other websites you visit. If you do not allow these cookies, you may not be able to use or see these sharing tools.

    Our uses of these technologies fall into the following general categories:

    • Essential. This includes technologies that allow you access to our Services, applications, and tools that are required to identify irregular website behavior, prevent fraudulent activity and improve security or that allow you to make use of our functionality. These technologies are essential for the Sites to function properly and enable basic features such as page navigation and access to secure areas of the Sites. 

    • Performance. We may use technologies to assess the performance of our Services, including as part of our analytic practices to help us understand how individuals use our Services. Some of our analytics partners include: 

    • Functional. We may use technologies that allow us to offer you enhanced functionality when accessing or using our Services. This may include identifying you when you sign into our Services or keeping track of your specified preferences, interests, or past items viewed.

    • Advertising or Targeting-Related. We may use first party or third-party Technologies to deliver content, including ads relevant to your interests, on our Services or on third-party websites. These cookies may be set through our Sites by our advertising providers. They may be used by those companies to build a profile of your interests and show you relevant advertisements on other sites. They do not store directly Personal Information but are based on uniquely identifying your browser and internet device. To learn more about this behavioral advertising practice, you can visit networkadvertising.org.

    You can manage the use of cookies through functionality built into your web browser or as provided on the Sites. Although you are not required to accept the Sites’ cookies, if you block or reject them, you may not have access to all features available through our Sites.

    2.3 – Information Collected from Other Sources

    We may, and often do, obtain information about you from other sources, including through Third-Party Services and organizations. For example, if you access our Services through a third-party application, such as an app store, a third-party login service, or a social networking site, we may collect Personal Data about you from that third-party application that you have made available via your privacy settings, or if, as part of signing up for our services, you link, integrate, or otherwise grant us access to other platforms. In addition, we may also collect Personal Data contained in a credit report from a consumer reporting agency or from other public information databases.

    Pipe users may, at times, provide us with Personal Data about other individuals, in particular customers of such users. For example, a Pipe user may upload transactional records which contain Personal Data about the individuals involved with such transactions.

    3. How We Disclose Your Information

    We disclose your Personal Data to third parties for a variety of business purposes, including to provide our Services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below.

    3.1 – Disclosures to Provide our Services

    The categories of third parties with whom we may share your information are described below. 

    • Other Pipe Users in Your Organization. The Services may allow you to share Personal Data or interact with other Pipe users in your organization. For example, parts of your Pipe profile may be accessible by other Pipe users in your organization.

    • Third-Party Services You Share or Interact With. The Services may allow you to share Personal Data or interact with Third-Party Services. For example, we may share Personal Data with referral or embedded partners who have referred our Services or integrated our Services into their platform and/or product.

    • “Buyside” and “Sellside” Participants. We may share Personal Data with our “buyside” and “sellside” Participants in limited circumstances that we determine are necessary or appropriate.

    • Service Providers. We may share your Personal Data with our third-party service providers who use that information to help us provide our Services. This includes service providers that provide us with IT support, hosting, payment processing, customer service, and related services.

    • Business Partners. We may share your Personal Data with business partners to provide you with a product or service you have requested. We may also share your Personal Data to business partners with whom we jointly offer products or services.

    • Affiliates. Your Personal Data may be shared between different group entities within our company or our affiliates. We make such transfers of Personal Data where it is necessary to provide you with our services or to manage our business. 

    • Advertising Partners. We may share your Personal Data with third-party advertising partners. These third-party advertising partners may set technologies and other tracking tools on our Services to collect Personal Data regarding your activities and your device (e.g., IP addresses, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. 

    • APIs/SDKs. We may share your Personal Data with third-party Application Program Interfaces (“APIs”) and Software Development Kits (“SDKs”) as part of the functionality of our Services. For more information about our use of APIs and SDKs, please contact us as set forth in “Contact Us” below.

    For customers in the United Kingdom (Bacs) and Canada (PAD), we use GoCardless to securely process your payments.  GoCardless Ltd (company registration number company registration number 07495895) is authorized by the Financial Conduct Authority under the Payment Services Regulations 2017, registration number 597190, for the provision of payment services. GoCardless uses personal data as described in their Privacy Notice. For customers in Australia (BECS): GoCardless Ltd (company registration number 07495895) is registered as a foreign company in Australia, ABN 17 606 261 74, and holds an Australian Financial Services licence (AFSL), number 478976.More information on how GoCardless processes your payments, Personal Data and your data protection rights, including your right to object, is available at http://gocardless.com/legal/privacy/

    3.2 - Disclosures to Protect Us or Others

    We may access, preserve, and disclose any Personal Data we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us or any “Buyside” participants; or assist with an investigation or prosecution of suspected or actual illegal activity.

    3.3 – Disclosure in the Event of Merger, Sale, or Other Asset Transfers

    If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your Personal Data may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

    3.4 – At Your Direction or With Your Consent. 

    We may also disclose your Personal Data when you have directed us to or if we have obtained your Consent (where required by applicable law).

    We reserve the right to provide non-Personal Data, such as aggregated data, to third parties.

    4. Our Lawful Basis for Processing of Personal Data

    Pipe’s processing of your Personal Data may be supported by the following lawful bases under applicable privacy and data protection laws including but not limited to: the United Kingdom General Data Protection Regulation and the European Union General Data Protection Regulation. 

    • Performance of a Contract: Pipe needs to process your Personal Data to perform our contract with you or in order to take steps at your request prior to you entering into a contract.

    • Legitimate Interest: Pipe may process your Personal Data to further its legitimate interests but only where our interests are not overridden by your interests or fundamental rights and freedoms. 

    • Consent: In some cases, Pipe relies on your Consent to process your Personal Data. 

    • Compliance with our Legal Obligations: Pipe may process your Personal Data to comply with our legal obligations or a court order. 

    5. Your Privacy Choices and Rights

    5.1 - Your Privacy Choices

    The privacy choices you may have about your Personal Data are determined by applicable law and are described below. 

    • Email and Telephone Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding our Services or updates to our Terms or this Policy). 

    • Text Messages. You may opt out of receiving text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us.

    • Cookies and Interest-Based Advertising. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. However, if you adjust your preferences, our Services may not work properly. Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt-out of personalized advertisements on some mobile applications by following the instructions for AndroidiOS and others. The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. You can access these and learn more about targeted advertising and consumer choice and privacy by visiting the Network Advertising Initiativethe Digital Advertising Alliancethe European Digital Advertising Alliance, and the Digital Advertising Alliance of Canada.  

    How Can you Disable Cookies?

    You can manage the use of cookies through functionality built into your web browser or as provided on the Sites. Although you are not required to accept the Sites’ cookies, if you block or reject them, you may not have access to all features available through the Website.

    If you want to learn more about cookies or how to control, disable, or delete them, please visit http://www.allaboutcookies.org for detailed guidance. We do not currently respond to “Do Not Track” signals.

    Please note you must separately opt out in each browser and on each device.

    5.2 - Your Privacy Rights

    In accordance with applicable law, you may have the right to:

    • Access Personal Data about you, including: (i) confirming whether we are processing your Personal Data; (ii) obtaining access to or a copy of your Personal Data in a structured, commonly used, and machine readable format; and (iii) receiving an electronic copy of Personal Data that you have provided to us;

    • Request correction of your Personal Data where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your Personal Data;

    • Request deletion/erasure of your Personal Data including with our Service Providers;

    • Request Restriction of or object to our processing of your Personal Data, including Personal Data that may be deemed sensitive;

    • Request to opt-out of the sale or sharing of your Personal Data; and

    • Withdraw your Consent to our processing of your Personal Data.

    While Pipe does not generally “sell” data, certain sharing of cardholder transaction data associated with our charge card products may be construed as a “sale” of data in some jurisdictions. Out of an abundance of caution, Pipe offers you the opportunity to opt out of this sharing.

    If you would like to exercise any of these rights, please contact us as set forth in “Contact Us” below. We will process such requests in accordance with applicable laws, including taking steps to verify your identity. 

    Shine the Light Law (Cal. Civ. Code § 1798.83): We only share Personal Data with third parties for direct marketing purposes if you either specifically opt-in, or are offered the opportunity to opt-out and elect not to opt-out of such sharing at the time you provide Personal Data when you choose to participate in a feature on the Sites. If you do not opt-in or if you opt-out at that time, we will not share your Personal Data with that identified third party for direct marketing purposes.

    “Do Not Track” Browser Settings: You are entitled to know how we respond to “Do Not Track” browser settings. Like many other websites, we do not currently alter our practices when we receive Do Not Track signals as there is no consensus among industry participants as to what “Do Not Track” means in this context. However, you have the option to opt-out of interest-based advertising. To find out more about “Do Not Track,” you may wish to visit www.allaboutdnt.com/.

    California Privacy Rights for Minor Users (California Business and Professions Code Section 22581):  California Business and Professions Code § 22581 allow California residents under the age of 18 who are registered users of online sites, services, or applications to request and obtain removal of content or information they have publicly posted. To request removal of such data, and if you are a California resident, you can contact us and include the email address associated with your Account. Be aware that your request does not guarantee complete or comprehensive removal of content or information posted online and that the law may not permit or require removal in certain circumstances.

    6. Security of Your Personal Data
